Work Injury Benefits Act (WIBA)
WIBA insurance covers your legal liability under the Work Injury Benefits Act 2007 for death or bodily injury caused by accidents or disease suffered by employees in the course of their employment. It relieves you of the financial burden of compensation and ensures injured employees are paid what the Act requires.
- Death
- Compensation equal to eight years of the employee's earnings, to support their dependants.
- Permanent total disablement
- Compensation equal to eight years of earnings, as assessed by a labour officer.
- Partial disablement
- Weekly payments for up to 104 weeks.
- Temporary total disablement
- Payments while the employee is unable to work during recovery.
- Medical expenses
- Actual medical costs after a workplace accident, up to KES 100,000.
The policy can be extended to 24-hour personal accident cover for non-occupational risks for an additional premium.
Employer's liability (common law)
Protects employers against legal liability under common law, negligence or breach of statutory duty for damages, claimant's costs and litigation expenses when employees suffer accidents, disease or death in the course of their employment. It pays compensation and legal fees if an employee or former employee sues over illness or injury caused by their work.
Public liability
Covers your legal liability to third parties for accidental death, bodily injury, illness, or loss of or damage to property arising in the course of your business. Under common law, anyone carrying on a business must do so without causing injury to members of the public or damage to their property. The policy also protects you against vicarious liability for the acts of your employees and contractors.
Product liability
Covers death, bodily injury, or loss of or damage to property suffered by third parties as a direct or indirect result of defective products you make, supply or sell.
Professional indemnity
Covers professionals against legal liability for negligence in the course of their work. The policy pays the damages you become legally obliged to pay because of a negligent act, error, mistake or omission in providing, or failing to provide, professional services. Reasonable legal defence costs are available in addition to the policy limit.
Contractual liability
Covers liabilities you take on under a contract, such as a lease or service agreement, including hold harmless clauses where you agree to be responsible for injuries, accidents or losses during the contract.
Fidelity guarantee
Protects against direct financial loss caused by fraud or dishonesty of employees. Cover applies to employees who handle money, stock, stores and accounting records.
